By accessing or using BTFY's content protection services ("Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use our Services.

These Terms constitute a legally binding agreement between you and Beautify LLC ("BTFY," "we," "us," or "our").

2. Eligibility

You must meet the following requirements to use our Services:

  • You are at least 18 years of age
  • You have the legal capacity to enter into this agreement
  • You are a content creator on eligible platforms (OnlyFans, Boosty, Ton Place, or similar)
  • You own or have the rights to the content you submit for protection
  • You are not prohibited from using our Services under applicable laws

3. Account Registration

3.1 Account Creation

To use our Services, you must create an account and provide accurate, complete information. You are responsible for maintaining the confidentiality of your account credentials.

3.2 Account Security

You are solely responsible for all activities that occur under your account. You must immediately notify us of any unauthorized access or security breach.

3.3 Account Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms or for any other reason at our sole discretion.

4. Services Description

4.1 Content Protection Services

BTFY provides the following services:

  • 24/7 monitoring of the internet for unauthorized distribution of your content
  • Automated detection of content leaks across various platforms and websites
  • Filing DMCA takedown notices on your behalf
  • Reporting and analytics on detected leaks and takedown activities
  • Customer support for content protection matters

4.2 Service Limitations

You acknowledge and agree that:

  • We cannot guarantee detection of all unauthorized content distribution
  • Takedown success depends on third-party platform cooperation
  • Some content may be redistributed before detection and removal
  • We are not responsible for content leaked before service activation
  • Services may experience temporary interruptions or maintenance periods

5. User Obligations

5.1 Content Ownership

You represent and warrant that:

  • You own or have rights to all content submitted for protection
  • Your content does not infringe on third-party intellectual property rights
  • You have authority to authorize DMCA takedown requests
  • All information provided is accurate and truthful

5.2 Platform Authorization

By connecting your content platform accounts, you authorize us to access necessary information to identify and protect your content. You are responsible for maintaining valid platform credentials.

5.3 Prohibited Activities

You agree not to:

  • Use our Services for illegal or unauthorized purposes
  • Submit false or fraudulent DMCA claims
  • Interfere with or disrupt our Services or servers
  • Attempt to gain unauthorized access to our systems
  • Reverse engineer or copy our technology
  • Resell or redistribute our Services without permission
  • Use automated systems to access our Services without authorization

6. Fees and Payment

6.1 Subscription Plans

Our Services are provided on a subscription basis. Current pricing is available on our website. We reserve the right to modify pricing with 30 days' notice to existing subscribers.

6.2 Payment Terms

  • Subscription fees are billed monthly or annually, as selected
  • Payment is due at the beginning of each billing period
  • All fees are non-refundable except as required by law
  • Failure to pay may result in service suspension or termination

6.3 Automatic Renewal

Subscriptions automatically renew unless canceled before the renewal date. You authorize us to charge your payment method for renewal fees.

6.4 Cancellation

You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial periods.

7. Intellectual Property

7.1 Our Rights

BTFY and all related trademarks, logos, and service marks are owned by us or our licensors. Our Services, including software, algorithms, and technology, are protected by intellectual property laws.

7.2 Your Content

You retain all rights to your content. By using our Services, you grant us a limited license to access, analyze, and use metadata about your content solely to provide our Services.

7.3 DMCA Authorization

You authorize us to act as your agent in filing DMCA takedown notices and represent that we have good faith belief in the validity of such notices.

8. Privacy and Data Protection

Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand our practices.

9. Disclaimers

OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

WE DO NOT WARRANT THAT OUR SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE, OR THAT ALL CONTENT LEAKS WILL BE DETECTED OR REMOVED.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BTFY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST REVENUE, OR LOST DATA, ARISING OUT OF OR RELATED TO YOUR USE OF OUR SERVICES.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY.

11. Indemnification

You agree to indemnify, defend, and hold harmless BTFY and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

  • Your violation of these Terms
  • Your violation of any law or third-party rights
  • Your content or use of our Services
  • False or fraudulent DMCA claims submitted through our Services

12. Dispute Resolution

12.1 Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law provisions.

12.2 Arbitration

Any disputes arising from these Terms or our Services shall be resolved through binding arbitration in accordance with the American Arbitration Association (AAA) rules, except where prohibited by law.

12.3 Class Action Waiver

You agree to resolve disputes on an individual basis and waive any right to participate in class actions or class-wide arbitration.

13. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes via email or through our Services. Continued use after changes become effective constitutes acceptance of the modified Terms.

14. Termination

Either party may terminate this agreement at any time. Upon termination:

  • Your access to Services will be discontinued
  • No refunds will be provided for unused subscription periods
  • We will delete or anonymize your data as described in our Privacy Policy
  • Provisions that should survive termination (e.g., indemnification) will remain in effect

15. Miscellaneous

15.1 Entire Agreement

These Terms, together with our Privacy Policy and DMCA Policy, constitute the entire agreement between you and BTFY regarding our Services.

15.2 Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions will continue in full force and effect.

15.3 No Waiver

Our failure to enforce any provision of these Terms does not constitute a waiver of that provision.

15.4 Assignment

You may not assign these Terms without our written consent. We may assign our rights and obligations without restriction.
