By using our services, you authorize BTFY to act on your behalf to:

  • Prepare and file DMCA takedown notices
  • Communicate with platforms regarding copyright claims
  • Follow up on takedown requests
  • Handle counter-notices as appropriate

3. DMCA Takedown Process

3.1 Content Monitoring

Our automated systems continuously monitor the internet for unauthorized distribution of your protected content across various platforms, including:

  • File-sharing websites
  • Social media platforms
  • Forums and discussion boards
  • Telegram and Discord channels
  • Search engine results
  • Other websites and platforms

3.2 Detection and Verification

When potential infringement is detected, we:

  • Verify that the content matches your protected material
  • Confirm that you are the legitimate copyright holder
  • Ensure the use is not covered by fair use or other exceptions
  • Document the infringing content and its location

3.3 Takedown Notice Submission

Upon verification, we file a DMCA takedown notice that includes:

  • Identification of the copyrighted work
  • Location of the infringing material (URL or specific location)
  • Your contact information (as copyright holder)
  • Statement of good faith belief that use is unauthorized
  • Statement that information is accurate under penalty of perjury
  • Physical or electronic signature of authorized representative

Important: All DMCA notices filed through BTFY are submitted under penalty of perjury. Filing false or fraudulent claims may result in legal consequences and immediate termination of service.

4. Counter-Notice Procedures

4.1 Receiving Counter-Notices

If a party files a counter-notice claiming that removed content was not infringing or was removed by mistake, we will:

  • Forward the counter-notice to you promptly
  • Inform you of your options and legal rights
  • Advise on appropriate responses
  • Assist in legal proceedings if necessary

4.2 Your Options

Upon receiving a counter-notice, you may:

  • File a lawsuit seeking a court order to restrain infringement (within 10-14 business days)
  • Accept the counter-notice and allow content restoration
  • Work with the counter-notice filer to resolve the dispute

5. Repeat Infringer Policy

5.1 Tracking Violations

We maintain records of DMCA takedowns and track repeat infringers across platforms. This information may be used to:
